🎩 Terms & Conditions

Terms & Conditions

When you purchase from Dapper Dahlias (aka The Gardening Moose), you agree to these terms and conditions:

1. Order Cancellations / Modifications

  • We do not accept order cancellations for any reason. Once you hit that Buy Now button, those dahlias are officially yours—no takebacks, no “oops, I changed my mind.”
  • Think of it like marriage vows but with flowers: for better or worse, in bloom or in cutting.
  • Inventory is limited, and every order reserves specific plants. Canceling would be like stealing candy from another gardener’s basket—not cool.
  • So please, double-check your cart before purchasing. If you’re not ready to commit, maybe take a lap around the garden first.
  • We do not combine multiple orders after they are placed and refund shipping costs.

2. Shipping & Delivery

  • Once your plants leave our greenhouse, they’re off on a UPS adventure. At that point, responsibility passes to the carrier—kind of like waving goodbye to your teenager with the car keys and hoping they don’t come back with dents.
  • We’ve built an excellent packing and shipping system for dahlia cuttings to give them the best chance of arriving safe, hydrated, and happy. But remember, travel can still be bumpy. A little yellowing, wilting, or bruising on arrival is normal—just give them water and encouragement.
  • No Combined Orders: If you place multiple orders, we do not combine them or refund shipping costs. So if you’re loading up the cart, think “all at once” rather than a dozen little shopping trips.
  • Claims & Photo Proof:
      - If a package arrives damaged, you must take photos of the box before opening it and photos of all contents inside.  We must be notified with 24 hours of the delivery time of any damage or issues with the plants.
      - Without photo evidence, claims with the shipping company cannot be filed—no pictures, no claim, no refund.
  • Shipping Options & Costs:
      - We ship exclusively via UPS—no PO Boxes.  If you give us an address that UPS will not deliver to, we will ship it via USPS and you'll assume all responsibility of any damages or delays that happen while the package is in the hands of the USPS.  USPS has been horribly to our plants in the past and we will only use them if you force us to.
      - You choose: UPS 2nd Day Air (flat $25) or UPS Next Day Air (flat $45).
      - Think of it as economy vs. first class. Either way, UPS is the pilot.

    Shipping Delays

Once an order has left our facility and is in the possession of the carrier, delivery times and handling are the sole responsibility of the shipping company. We do not control carrier operations or transit timelines. If a package is delayed, lost, or delivered later than the paid shipping method indicates, Dapper Dahlias by Moose is not responsible for refunds, replacements, or damages resulting from such delays. We encourage customers to contact the carrier directly for tracking updates or delivery issues.

4. Failure, Disease, or Poor Performance

  • Plants are living things, not toaster ovens—sometimes they thrive, sometimes they sulk, and sometimes they outright ghost you.
  • If a plant fails within 3 days of arrival, contact us with clear photos so we can help troubleshoot and decide if a replacement or refund (plant cost only) is appropriate.  This will be at our discretion.
  • To qualify, you must have followed our published planting and care instructions. If you drowned it, fried it in full sun, or let your neighbor’s goat snack on it, that one’s on you.
  • We do not offer refunds or replacements for:
      - Poor tuber production (dahlias are moody about making storage organs).
      - Plant loss reported after 3 days.
      - Issues caused by pests, weather, soil problems, or improper care.
      - Any virus concerns reported beyond 3 days of receiving your order (see Section 7 for full virus policy).
  • Moose Bottom Line: We’ll back you up if something’s wrong at the start, but after 3 days, your dahlias are officially your responsibility.

5. Variety Not Available

  • If something happens to a plant before we ship, we will cancel and refund the item we cannot fulfill while still shipping the rest of your order as planned.
  • We don’t play substitution games—if we don’t have it, we won’t slip something else in the box.
  • Moose Translation: If a variety doesn’t make it to shipping day, you’ll get your money back for that item, and the rest of your order will keep marching on.

7. Virus & Disease Disclaimer

  • Dahlias, like that one cousin who always shows up uninvited, almost always come with some baggage. According to the American Dahlia Society Genome Project, it’s estimated that 87% of all dahlias in cultivation already carry one or more viruses. Yep—nearly all of them.
  • Viruses are sneaky little things. They can spread from a single insect bite, a dirty pair of pruners, or even by brushing against another infected plant. They’re also hanging out all over the place: in your yard, in weeds, in landscape plants, even in your houseplants. In short: virus exposure is everywhere.
  • While we practice strict sanitation when propagating (clean tools, disinfectants, separation of stock), we cannot—and no grower can—guarantee virus-free plants.
  • Policy:
      - If you suspect a virus in your cuttings, you must report it within 3 days of delivery with clear photos of the entire cutting.  If, at our sole discretion, we do not agree that the plant shows clear, visible signs of a virus, you may opt to have the plant tested for virus at a certified laboratory (no at home testing) and if the results show the plant is viral, we will issue a refund.  The testing must be submitted within 3 days of the delivery date.
      - After 3 days, we cannot accept responsibility, because once the plants are in your care they can be exposed to countless possible sources of virus.
      - Because viruses can be latent or symptomless at shipping, we make no guarantees or warranties against the presence of virus.
  • Viruses don’t automatically mean your dahlia is doomed. Many grow and bloom beautifully for years, even carrying a virus. It’s up to each grower to decide what level of tolerance works for them.
  • Moose Translation: Dahlias and viruses go together like peanut butter and jelly—common, sticky, and sometimes messy. We’ll send you strong, healthy cuttings, but if a virus pops up after 3 days, it’s officially out of our hooves.

8. Payment & Methods

  • Full payment is due at the time of order placement.
  • We accept all major credit cards, digital wallets, and payment methods shown at checkout.

9. Limitation of Liability

  • Our liability is limited to the cost of the plants you purchased (excluding shipping, labor, or incidental costs).
  • We are not responsible for incidental, indirect, or consequential damages (lost income, labor, or time).

10. Changes to Terms

  • We reserve the right to update or revise these Terms & Conditions at any time.
  • Updates take effect immediately upon posting to this page.

11. Contact & Dispute Resolution

  • For any issues or claims, please contact us by email (not social media) at moose@dapperdahliasbymoose.com within 24 hours of delivery time.
  • We aim to respond within 2 business days to legitimate claims.  Moose doesn't work weekends.
  • Negative public reviews or posts made before contacting us directly may affect your eligibility for resolution or compensation.
  • These Terms & Conditions shall be governed by and construed under the laws of the State of Utah, without regard to conflict of law principles. Any disputes must be brought in the state or federal courts located in Cache County, Utah.

12. Returns & Restocking Fee

If, at our sole discretion, we decide to approve a return or refund outside of our stated policy, we reserve the right to deduct up to a 15% restocking and handling fee from the refund amount. This fee covers payment processing costs, administrative time, and labor involved in inspecting, restocking, and managing returned items. Shipping charges are non-refundable.
